Is Cannabis / THC legal in Belarus?

Legal status

Cannabis is controlled in Belarus, and the annex reaches it through four separate printed rows rather than through one. The республиканский перечень annexed to Постановление Министерства здравоохранения № 19 от 11 февраля 2015 г. prints, in Список 5, headed «опасных наркотических средств, не используемых в медицинских целях», the entries 5.1 «Гашиш», 5.4 «Марихуана» and 5.5 «Масло каннабиса (гашишное масло)», each defined against the parts or products of «растений рода Cannabis» containing any isomer of tetrahydrocannabinol, and separately prints 1.2.9 «Тетрагидроканнабинол» in Список 1. The applied cell quoted «КАННАБИС, растение» at a registry number. That string is not printed in this annex, and the annex prints no registry numbers at all: its two columns are the international non-proprietary or other non-scientific name and the chemical structure or short description. Where the applied cell said a plant entry catches plant material and says nothing about an isolated constituent, the annex is more specific than that. Марихуана is defined by exclusion, reaching any part of the plant whole or comminuted, dried or undried, other than whole seeds unaccompanied by other plant parts, and other than the root system. Consequences if caught

Capital exposure: none. Belarus retains capital punishment as a country, and that is exactly why this line has to be read carefully rather than skimmed: no drug offence in Criminal Code articles 327 to 328 with a superscript one carries it. The entry relied on for cannabis is «Марихуана». The ceiling for a drug offence is 25 years. Criminal Code article 328(5) provides a term of twelve to twenty-five years. That is the top of the drug scale and it is not death. A source that reports three quantity bands for Belarus has read another country's structure into it. Resolution No. 606 gives one. The quantity instrument prints this row as «instrument gives no significant band»; «large size: over 80.0 g»; «instrument gives no separate especially-large band». Resolution No. 606 gives a large-size figure and nothing else. Where this row says the instrument gives no significant band or no especially large band, that is the instrument's own silence and not a gap in the reading.

If prescribed or medical

The traveller rule is stated at country level and it is the same for every substance in this set: Belarus provides no lawful personal use allowance and no traveller exemption, and a scheduled medicine has to satisfy Закон Республики Беларусь «О лекарственных средствах» as well as the narcotics annexes, meaning prescription, original packaging, and import and customs formalities. The placement for this row is Список 5 of the республиканский перечень, whose own heading says its substances are not used for medical purposes, so a medicinal route does not run through that list at all. The isolated cannabinoid sits elsewhere, at 1.2.9 «Тетрагидроканнабинол» in Список 1. A criminal quantity band is not a lawful traveller allowance. Documentation

Carry it only with the Belarusian prescription and dispensing paperwork the medicines law requires, in the original dispensing packaging. Name the material on any declaration the way the annex names it, «Марихуана» for plant material, «Гашиш» for resin and «Масло каннабиса» for an extract, because those are the three separate printed rows and a description that mixes them describes nothing the annex prints. Do not quote a registry number, because this annex carries none. The rows were read on 21 September 2026 and a later amendment can change them, so recheck before travel rather than relying on the date on this cell.
