Caffeine is not controlled in Moldova, and that is a completed finding rather than an open question. The second instrument, Criminal Code arts 217 and 2171, did not convert this ordinary product term into a scheduled narcotic or psychotropic substance. Moldova splits the question across two instruments. Government Decision HG1088/2004 carries the controlled Tables I to III and answers classification. HG79/2006 carries the quantity annex and prints small, large and especially large amounts. The Criminal Code, Law No. 985/2002, supplies the offences at articles 217 and 217 with a superscript one. Consequences if caught
Capital and life exposure. Moldova has no death penalty and no life sentence for a drug offence. And none of the drug penalties reach caffeine, because they attach to the substances on the Moldova list and caffeine is not one of them. The ceiling is 15 years. Criminal Code article 217 with a superscript one, subsection (4), provides a term of seven to fifteen years. Article 217 covers illegal circulation not for the purpose of sale and carries the lower personal band. Those provisions are stated here so the scale is visible, not because they apply to caffeine.
