Is Ayahuasca legal in Turkey?
- Legal status
- Ayahuasca is not confirmed as a controlled preparation in Turkey and this row is a deferral rather than a finding. The dossier searched the Turkish terms «ayahuasca» and «ayavaska» and the transliterations ayahuasca and ayavaska against the classification decisions made under article 19 of Law No. 2313 on the Control of Narcotic Substances, and confirmed no current entry. It rejected the near match «DMT», because the constituent does not settle the preparation. That is the whole difficulty of this row stated in a line: DMT is verified as scheduled on its own row, the brew contains it, and Turkish law reaches a preparation only where a decision names the preparation or where the material is found to contain a named substance. Cannabis shows how the legislature closes that gap when it wants to, because article 3 of Law No. 2313 names esrar expressly and article 23 creates a cultivation offence; nothing comparable was found for this preparation.
- Consequences if caught
- Capital exposure: none. No article in this chain carries a capital or whole life route, and no per-substance threshold was verified for this row. The exposure does not depend on ayahuasca being named. A liquid found on analysis to contain DMT is charged on DMT, which is scheduled, so article 188(3) of Penal Code No. 5237 would set not less than ten years for transporting, storing, purchasing, accepting or possessing it, article 188(1) would set twenty to thirty years for importing it, and article 191(1) would set two to five years for possession for use. Article 190(1) reaches the organiser separately, at five to ten years and a fine of one thousand to ten thousand days, for providing a place, equipment or materials to facilitate use or giving others information about methods of use, which is the provision that fits a retreat rather than a sale. A ceremonial context is nowhere recognised in either instrument.
- If prescribed or medical
- There is no prescription route for ayahuasca in Turkey. It is not a medicine, holds no authorisation, and the dossier carried no prescription instrument for this row, so no per-substance medical route is asserted here. Article 188(6) of the Penal Code reaches permission bound or prescription bound substances producing a narcotic or stimulant effect, and a traditional brew satisfies neither limb. Religious and therapeutic framings have no legal standing in the text that was read.
- Documentation
- Nothing documents an unconfirmed preparation, and this is a row where the unconfirmed status is actively misleading. The absence of an entry for the brew does not protect the person carrying it, because the analysis required under article 20 of Law No. 2313 reports the alkaloid rather than the recipe, and the alkaloid is scheduled. A letter from a retreat, a customs declaration describing the liquid as a herbal tea and a certificate of traditional use all count for nothing against that report. The search log was read in the dossier on 18 September 2026 and articles 3, 19, 20 and 23 with articles 188, 190 and 191 were read from the consolidated texts on 20 September 2026.
- Turkey, Law No. 2313 on the Control of Narcotic Substances of 12 June 1933, articles 3, 19, 20 and 23, with the Turkish Penal Code No. 5237, articles 188(1), 188(3), 188(6), 190(1) and 191(1)
- the consolidated texts were read at https://www.mevzuat.gov.tr/mevzuatmetin/1.3.2313.pdf (HTTP 200, 220,153 bytes) and https://www.mevzuat.gov.tr/mevzuatmetin/1.5.5237.pdf (HTTP 200, 1,070,143 bytes), both fetched on 20 September 2026. The dossier's own url column holds one identical string for all 88 Turkey rows and that string is these two addresses run together with no separator, so the citation it supplies is document level rather than per substance. The annexes to the ten decisions footnoted to article 19 are not reproduced in the consolidated statute and were not read.
