Is Amphetamine legal in Ukraine?
- Legal status
- Controlled in Ukraine by its own Cyrillic heading. Постанова № 770, таблиці I to IV, consolidated text read on 20 September 2026, prints «Амфетамін» and fixes it at CAS 300-62-9, and record UKR-18 accepts that row. The heading is given here in sentence case because the list prints in capitals. The same source separately reports a Latin spelling for the branded product row at the identical CAS 300-62-9, and that duplication is unexplained: either the list prints the substance twice in two alphabets or one of the two records transcribed the other. Nothing turns on it for the control itself, which is established, but a cell that quoted only one spelling would be hiding a discrepancy in its own source. Substance identity belongs to the Перелік under стаття 7 of the controlled substances law. Add the script point. The duplicate at the same registry number, on record UKR-14, is printed in Latin while this one is Cyrillic, and only two of the 43 accepted entries in this dossier are Latin at all. The tension is named here and in that row and it is not settled by either: the source does not say whether the annex prints this substance twice or whether one record transcribed the other.
- Consequences if caught
- Capital exposure: none. There is no death penalty in Ukrainian law. The trade article the source names is Кримінальний кодекс України, стаття 307, whose third part carries a ceiling of twelve years of imprisonment, with no life sentence in the article. The heading at CAS 300-62-9 is matched by name, so наказ МОЗ № 188 supplies the small, large and especially large figures and those figures decide which part of стаття 307 is engaged. This source does not reproduce them, so no weight is stated here. Because the same CAS appears under two spellings in the source, an officer's citation may differ from the spelling quoted in this cell without the substance being different. No separate possession article is named. Separately from that, and carried forward from this site's published Ukraine entry rather than re-derived from the Code in this pass, the published penalties are these. Personal use of a small amount is administrative under article 44 of the Code of Administrative Offenses, a fine of 25 to 50 tax free minimum incomes, 20 to 60 hours of community service, or administrative arrest of up to 15 days. Above small, personal use under article 309 is criminal, a fine, correctional labour of up to two years, or restriction of liberty of up to five years, rising to up to three years where aggravated or large and up to eight years where a minor is involved. Trafficking or sale under article 307 draws four to twelve years with property forfeiture. Smuggling under article 305 draws five to eight years, and up to eight to ten years aggravated. The published entry records the small, large and especially large quantity thresholds as very low, and that trace amounts have triggered article 309. Drug use itself, other than in public, is not criminal there. Every figure in this paragraph is a penalty range or a fine and none of them is a quantity threshold. They describe the offences that this row's placement in the Ukrainian list brings into play.
- If prescribed or medical
- No personal use quantity is lawful in Ukraine, наказ МОЗ № 188 grades criminal conduct rather than licensing a traveller, and a scheduled medicine must also satisfy Закон України «Про лікарські засоби» on prescription, packaging, import and customs. This row's placement is a matched heading at CAS 300-62-9, and amphetamine reaches travellers mainly as a prescribed stimulant rather than as a bare substance. The mechanism by which such a prescription is recognised at the Ukrainian border, if it is, was not established in this source and was not researched beyond it. Carrying a prescription is necessary on this record and cannot be described as sufficient.
- Documentation
- Carry the prescription and the original dispensing pack with the pharmacy label in the patient's own name, plus a prescriber's letter that names the active ingredient, the strength, the daily dose, the treatment period and the total quantity carried. Name the ingredient rather than the brand, because the Ukrainian heading at CAS 300-62-9 is what an officer matches against and the source shows that heading can be cited in either alphabet. Keep the quantity inside the stated treatment period and declare it on arrival. The consolidated list was read on 20 September 2026 and later amendments must be rechecked.
- Ukraine, Постанова Кабінету Міністрів України № 770 від 6 травня 2000 року, Перелік, таблиці I to IV
- printed heading «Амфетамін» at CAS 300-62-9, record UKR-18, sentence case for a heading the list prints in capitals
- the same source reports record UKR-14 at the identical CAS 300-62-9 under a Latin spelling and does not reconcile the two. Consolidated text read at https://zakon.rada.gov.ua/laws/show/770-2000-%D0%BF#Text as at 20 September 2026. 307, https://zakon.rada.gov.ua/laws/show/2341-14#Text. Note on script: this accepted entry is Cyrillic and the entry at the identical registry number on record UKR-14 is Latin, one of only two Latin entries among the 43 accepted in this dossier
- the tension is named in both cells and settled in neither.
- the article 44, 305, 307 and 309 penalties stated above are carried forward from this site's published Ukraine entry, which cites the Criminal Code articles 305, 307, 309 and 310, the Code of Administrative Offenses article 44 and Ministry of Health Order No. 188. They were not re-derived from the Code in this pass, and the published entry's own hedges, that the thresholds are very low and that trace amounts have triggered article 309, are carried with them
