Is Amanita muscaria legal in Mexico?

Confirmed against a primary sourceVerified September 18, 2026
Legal status
Amanita muscaria is a mushroom whose active compounds are not the scheduled ones, so articles 234 and 245 of the Ley General de Salud return no single entry under that name. Mexico prints named substances in those two articles rather than classes, and a yes or no in one line would collapse materials the Act treats differently. Control follows whatever named substance is actually present, and every constituent this site covers is answered on its own page.
Consequences if caught
No offence follows from the name by itself, and a proved listed constituent carries the exposure. Article 478 is a conditional no-prosecution rule and not a legal allowance. At or below the table amount, for strict immediate personal consumption and outside the protected places article 475 refers to, the prosecutor does not bring the article 477 case. Article 477 otherwise sets ten months to three years for non-commercial possession below one thousand times the table amount. Mexico has no death penalty for any offence, which article 22 of the Constitucion Politica de los Estados Unidos Mexicanos settles. The federal trafficking ceiling is twenty five years under article 194 of the Codigo Penal Federal, and the small-scale ceiling is eight years under article 475 of the Ley General de Salud.
If prescribed or medical
No single prescription answer attaches to the name. Where a constituent is itself listed, that constituent's own prescription and record-keeping duties under articles 240 onward apply, and a product sold abroad without a prescription does not become lawful here on that ground.
Documentation
Carry nothing on the strength of the category name, because the category is not what articles 234 and 245 read. Identify the constituent actually present and carry its prescription and labelled packaging if it has one. Mexico was checked on 18 September 2026.
