Is Alcohol legal in India?

Confirmed against a primary sourceVerified July 14, 2026
Legal status
Legal but state-regulated — alcohol (ethanol) is a State-List subject; most states license sale with a minimum age of 18-25, while dry states (Gujarat, Bihar, Nagaland, Mizoram, Lakshadweep) prohibit it outright.
Consequences if caught
No penalty for adult drinking in 'wet' states; in prohibition states (notably Bihar and Gujarat) possession or consumption of alcohol brings arrest, fines and imprisonment.
If prescribed or medical
n/a — a beverage, not a medicine.
Documentation
Bought at state-licensed liquor shops on proof of age where legal; dry states require a health/tourist liquor permit or bar it entirely.
