Is Alcohol legal in Andorra?
- Legal status
- Legal for adults in Andorra, with sale to under-18s a criminal offence and drinking in the street banned for everyone outside authorised areas and hours. Article 286 bis of Andorra's Penal Code (Codi Penal) treats as an alcoholic drink one «superior a 1,0 graus percentuals del seu volum», and article 286 ter provides «El qui vengui alcohol a menors de 18 anys, ha de ser castigat amb pena de presó fins a un any o d’arrest i multa fins a 6.000 euros». Article 35.2 of Llei 31/2021, del 22 de novembre, de text consolidat qualificada de seguretat pública, provides «Resten prohibits el consum de begudes alcohòliques a les vies, als espais, a l’interior dels béns immobles de titularitat pública i als transports públics», except for adults, within the hours the competent authority sets for it, on authorised terraces and in areas set up for authorised festivals and events. Alcohol is not a toxic drug under article 281: it is not named in the UN edition of the 1961 Single Convention schedules as at 6 June 2024 (ST/CND/1/Add.1/Rev.11) or the UN edition of the 1971 Convention schedules as at 3 December 2024 (ST/CND/1/Add.2/Rev.10).
- Consequences if caught
- Drinking in a public street or space against article 35.2 of Llei 31/2021 is an administrative infraction under its article 58.1.b, fined 300 euros under article 59.2, and under article 60 a police officer «comissa i destrueix posteriorment les begudes alcohòliques»; under article 61.1 a non-resident foreigner who does not pay voluntarily must lodge a deposit equal to the fine. Article 499 bis of Andorra's Penal Code (Codi Penal) punishes giving alcohol to an under-18 without profit with arrest and a fine of up to 1,000 euros, and article 35.1 of Llei 31/2021 provides «Resten prohibits, la tinença o el consum de begudes alcohòliques per part de menors d’edat». Driving with «un grau d’alcoholèmia superior a 0’8 g/l de sang», or under the influence of alcohol, is punished under article 268.1 with imprisonment of up to one year or arrest, loss of the right to drive for up to three years and a fine of 300 to 3,000 euros; article 268.2 sets a 0.5 g/l limit and up to two years for drivers of buses, heavy vehicles, trains, aircraft and cable transport. Article 8.3 of the Constitution provides «Es prohibeix la pena de mort.» Llei 18/2026, del 15 de juliol, qualificada del Codi penal, published in the BOPA on 13 August 2026, the date the BOPA's search index records for it, repeals Llei 9/2005 and provides «Aquesta Llei entrarà en vigor al cap de quatre mesos de la seva publicació». A mechanical comparison made in this run found its articles 314 to 323, 545 and 547 carry articles 281 to 288, 499 and 500 over with the same offences and penalties; the differences are renumbered cross references and three small changes of wording. Articles 288 bis, 288 quater and 499 bis become articles 324, 326 and 546. Its article 300, which replaces article 268, also reaches a driver «quan del resultat d’una anàlisi de sang o de saliva es desprengui que ha consumit drogues o substàncies d’efectes anàlegs», in paragraph 1 and in the stricter paragraph 2 alike, extends paragraph 1 to a person accompanying a learner driver or the holder of a J permit, and drops the arrest alternative from paragraph 1.
