7-Hydroxymitragynine (7-OH) in Austria: not individually verified
We have not confirmed that 7-Hydroxymitragynine (7-OH) specifically is scheduled in Austria, so this page gives no legal status. Publishing a guess here would be worse than publishing nothing. What we do know is the governing national drug law, below.
- What is on record
- Not confirmed. The designation of isolated or manufactured 7-hydroxymitragynine could not be settled in Austria, and the obstacle is structural rather than evidential. Oxidation changes the indole core, so Annex II group 6 of the NPS regulation, which requires a derivation from tryptamine, does not obviously reach an oxidized fused indolenine skeleton. Group 2 permits polycyclic replacement, but no conclusive fit to that wording was established either, which leaves the compound between two definitions rather than inside one. There is no entry for it in the narcotics instrument and no demonstrated extension from a listed parent, and none in the psychotrope instrument. Synthetic origin under NPSG §1 is an additional necessary fact for the NPS route and not a universal exemption for an isolated alkaloid. No prescription listing was found under either the hydroxymitragynine or the mitragynine spelling, the medicine definition requires product specific facts that were not supplied, and the novel food and general food provisions govern marketing without determining designation. The public chemistry record fixes the molecular formula and connectivity and supplies no Austrian legal interpretation. This is a genuinely open question and it is recorded as one.
