Legality · 5-MeO-DMT (Bufo / Toad)5-MeO-DMT (Bufo / Toad) in Austria: not individually verified
Also known as: the god molecule
Not individually verified
We have not confirmed that 5-MeO-DMT (Bufo / Toad) specifically is scheduled in Austria, so this page gives no legal status. Publishing a guess here would be worse than publishing nothing. What we do know is the governing national drug law, below.
- What is on record
- Not confirmed. The Austrian designation of 5-MeO-DMT could not be settled, and the reason is a specific interpretive gap rather than an absence of searching. The narcotics instrument holds no literal 5-MeO-DMT entry. It could be reached only by applying two extensions in succession, treating the compound as an ether of a positional isomer of the listed psilocin, and whether those extensions may be applied one after the other is exactly what is unresolved. The 5-methoxy position is not the direct 4-O-methyl ether of psilocin, which is what breaks the single step route. The psychotrope instrument carries no designation for it. Annex II group 6 of the NPS regulation covers tryptamine and compounds derivable from it, and the tryptamine core with 5-methoxy and N-methyl substitutions does fit that wording, but NPSG §2(2) prevents using NPS coverage to bypass the narcotics question, so the applicable penalty regime turns on the unresolved point. No prescription entry was located, the medicines act defines medicines by presentation and function without deciding a scheduling boundary, and the structural identity in the public chemistry record informs the question without supplying any Austrian legal interpretation. This cell will not assert a placement it does not hold.

Controlled in Austria as a Suchtgift, a narcotic in the strict statutory sense. 4-AcO-DMT is not named at all; it is reached because Annex V.1 lists psilocin and psilotin and then extends that list to the esters, ethers and molecular compounds of the narcotics named under V.1. 4-AcO-DMT is the O-acetyl ester of psilocin, so the express ester limb catches it without any analogue reasoning. The SMG takes priority over the NPS regime, so this is a narcotics question and not a new psychoactive substance question. Austria designates by delegated regulation rather than by naming substances in the Act. SMG §2(1) requires both convention restriction and a ministerial designation, and the annexes of the Suchtgiftverordnung are that designation. SV §1(5) extends a listing to every stereoisomer and to those positional isomers whose structural similarity gives a comparable pharmacological effect, and it is not an open analogue clause; the annexes I.1.c, I.2, II, IV.1, V.1 and V.2 carry their own salts, esters, ethers and preparations extensions, which are read where they sit and not transplanted.

Controlled in Austria under the new psychoactive substances regime, and not as a narcotic or a psychotrope. The placement is group 6 of the NPS regulation's structural annexes: 4-HO-MET is not named; Annex II group 6 covers tryptamine and any compound derivable from that base structure, including one bearing the substituents permitted by NPSV §1(2). 4-HO-MET keeps the tryptamine core with a 4-hydroxy group and N-methyl and N-ethyl substituents, which fits group 6 for synthetic material. The dossier is careful on the boundary with the narcotics list: the extra N-ethyl carbon prevents treating it as a positional isomer of the listed psilocin, so the SV §1(5) isomer rule does not reach it. Austria regulates new psychoactive substances by structure rather than by list alone. NPSG §1 additionally requires psychoactivity and synthetic manufacture, and §2 excludes lawful medicinal channels and anything already subject to the Suchtmittelgesetz, so the SMG is applied first and the NPS scope second. The twelve cannabinomimetic cores and the other group definitions are alternatives rather than a catch all, and the annex has to be read as written rather than as a general ban on novel compounds.

Controlled as a Suchtgift, placed there by regulation rather than by the statute itself. In the Suchtgiftverordnung, Annex V.1 carries the three letters DMT. The same annex then extends itself to all preparations of the narcotics it names, which is how brews and infusions containing it are reached. That entry is a bare name. It establishes placement and nothing else, and the conduct rules live in SMG §5(1) and in the §27 offence rather than in the schedule line. The statute does not carry the list. SMG §2(1) sets a two part test of convention restriction plus ministerial designation, SMG §2(3) allows a national addition where a substance has a comparable danger potential by reason of its effect and spread, and the Suchtgiftverordnung annexes supply the designation. Each annex is read on its own terms. The extension clauses differ between I.1.c, I.2, II, IV.1, V.1 and V.2, and SV §1(5) supplies the isomer rule for all of them without becoming a general analogue provision.

Controlled as a Suchtgift, placed there by regulation rather than by the statute itself. In the Suchtgiftverordnung, Annex V.1 prints Psilocybin. Psilocin and psilotin are listed separately in the same annex, and SMG §27(1)(3) carries a distinct conduct rule for psilocybin containing mushrooms. That entry is a bare name. It establishes placement and nothing else, and the conduct rules live in SMG §5(1) and in the §27 offence rather than in the schedule line. The statute does not carry the list.
